On May 3, Roohan Realty filed a lawsuit with the New York State Supreme Court in Saratoga County against Stonerside Stables, LLC. The company claims it’s owed commission on the sale of 36 Nelson Ave. in Saratoga Springs. The 106-acre property, which was listed at $19 million, was sold in January for approximately $17.5 million. The 5 percent commission owed would be nearly $875,000.
Court documents show Robert McNair, owner of the Paris, Ky., based Stonerside Stables and the NFL team the Houston Texans, signed an exclusive right to sell listing lasting from August 2004 to August 2005 with the local realtor. The lawsuit claims he “failed and refused to pay the commission.” McNair sold the Nelson Ave. horse farm to Sheik Mohammed bin Rashid al-Maktoum’s Darley Stud Management, which owns Preakness winner Bernardini. Sheik Mohammed, a well known horse owner and endurance racer, is the ruler of Dubai and prime minister of the United Arab Emirates. Roohan’s attorney Michele L. Anderson said it was too early in the litigation to comment on anything. She said they are in the process of taking testimony and collecting documents. Paul Sullivan, the attorney representing Stonerside Stables, LLC, said Roohan never found a buyer for the property and the listing contract expired more than a year before the property was sold. Sullivan believes the case will be in and out of court quickly. “We know of no basis for the claim,” Sullivan said. |
